Background

  • May 25, 2020: Christopher Hall was charged with one count of domestic violence (R.C. 2919.25(A)) after an incident with his then-girlfriend, Tammie Smith.
  • Smith testified Hall slammed her to the ground, choked her, pulled her hair, and caused visible marks; Hall testified he pushed her in self-defense and denied choking her.
  • Officer Contris photographed Smith’s injuries the night of the incident and prepared a report.
  • Hall filed a written discovery demand (May 29, 2020); the prosecution did not produce the photographs until the morning of the July 16, 2020 bench trial.
  • Defense moved in limine to exclude the belatedly produced photos; the trial court refused to exclude them, offered a continuance which defense declined, and convicted Hall after one day of trial.
