Background

  • Gardner was indicted on multiple counts after the April 14, 2021 fatal beating of 70-year-old Leonard Craddock; state proceeded at trial on felony murder (R.C. 2903.02(B)) and felonious assault (R.C. 2903.11(A)(1)) based on aiding-and-abetting liability.
  • Surveillance and witness testimony showed Gardner confronted Craddock at Family Dollar, retrieved a pouch of cash, then followed and struck him outside and inside an AutoZone while loudly threatening him.
  • Two men arrived after speaking with Gardner; they later returned, dragged Craddock outside, and brutally beat him; Craddock died of blunt-force injuries. Video showed Gardner remained on scene for 12 minutes and left with the two men.
  • Post-arrest jail calls captured Gardner discussing bond money, saying she would "sing like a bird" and referencing the men; prosecution offered the calls to rebut her claimed lack of connection to the assailants. DNA did not link Gardner to the body or crime scene.
  • The jury found Gardner guilty of one count of murder (felony murder) and one count of felonious assault; the court merged counts and sentenced her to life with parole eligibility after 15 years.
  • Gardner appealed asserting (1) insufficiency/manifest-weight error, (2) prejudicial admission of jail calls, and (3) ineffective assistance of counsel for failing to object to those calls.

Issues

Issue Plaintiff's Argument Defendant's Argument Held
Sufficiency / Manifest weight of the evidence (aiding and abetting felony murder) State: evidence (surveillance, witness ID/interaction, Gardner's aggressive conduct, her conversations with the two men, jail calls, presence throughout attack) shows Gardner aided and shared intent with principals Gardner: mere presence and lack of forensic (DNA/phone) link insufficient to prove complicity Court: Weight of evidence supports conviction; not an extraordinary case; sufficiency follows from weight — assignments overruled
Admission of jail calls (prejudicial/hearsay) State: calls are party-opponent admissions under Evid.R. 801(D)(2) and rebut Gardner's denial of connection to assailants Gardner: calls were prejudicial and should've been excluded Court: calls admissible as admissions; no plain error; probative value not outweighed by prejudice
Ineffective assistance of counsel (failure to object to calls) N/A (responded that even without calls evidence remains overwhelming) Gardner: counsel ineffective; verdict turned on jail calls Court: Strickland not satisfied — performance and prejudice prongs fail because outcome would not have differed without calls
