State v. Doughty, 2022 Ohio 1854

Defendant James R. Doughty was convicted of multiple offenses and sentenced under the Reagan Tokes Act to an indefinite term of 14 to 17.5 years.
On direct appeal, Doughty raised a second assignment of error challenging the constitutionality of the Reagan Tokes Act (jury-trial, due process, equal protection, separation of powers).
The Fifth District originally declined to reach that assignment of error as not ripe, but the Ohio Supreme Court in State v. Maddox held such challenges are ripe on direct appeal and remanded.
On remand the Fifth District addressed Doughty’s constitutional challenges.
The court rejected Doughty’s claims and affirmed the trial court’s judgment, adopting the dissenting reasoning from State v. Wolfe and relying on other Ohio appellate decisions upholding the Act.
