Background:

  • On Christmas Eve 2017, Edward Brown (defendant) and his girlfriend H.H. argued with their adult daughter A.B. and A.B.’s boyfriend M.M.; the next morning Brown and M.M. again argued while A.B. and M.M. were packing to leave.
  • Brown carried a knife; during the morning confrontation M.M. picked up a large furniture clamp; witnesses disagree about who was the aggressor; M.M. was ultimately stabbed in the back/shoulder and called 9-1-1.
  • M.M. and A.B. testified Brown approached and stabbed M.M. while M.M. was leaving and not advancing; Brown and H.H. testified M.M. was violent, had shoved H.H., charged with the clamp, and posed imminent danger.
  • Brown was indicted for felonious assault (deadly-weapon allegation), tried by jury, convicted, and sentenced to three years’ imprisonment.
