Background

  • Lisa and Wayne Mendoza purchased marital property at 3716 Gallo Drive during marriage; the marriage ended by divorce in 2000, terminating the community regime as of the 1999 petition filing date.
  • The house was destroyed by Hurricane Katrina (2005). Lisa, the occupant, applied for and received a Road Home grant of $128,180 in 2007 and executed the Road Home Affidavit, Grant Agreement, and Covenants identifying herself as the homeowner and obligor.
  • The Covenants limited transfer and required occupancy/insurance for three years and were to be recorded; breach could trigger repayment and create a judicial mortgage against the property.
  • Lisa used Road Home funds to rebuild the co-owned property, testified she paid no out-of-pocket funds, and submitted repair costs of $125,136.
  • Wayne filed for partition in 2015; at trial Lisa sought reimbursement of half the Road Home funds she expended. The trial court denied reimbursement, concluding Lisa failed to prove reimbursable expenditures and that the Road Home funds were a grant to both owners.
  • On appeal the court affirmed, holding the Road Home proceeds were effectively grant proceeds payable to both co-owners and denying equitable or Civil Code-based reimbursement.

Issues

Issue Plaintiff's Argument (Mendoza) Defendant's Argument (Wayne) Held
Are Road Home funds Lisa's separate property or co-owned? Funds are Lisa's separate property because she alone applied, contracted, and performed under the grant. Road Home proceeds attach to the co-owned property and are intended to be paid jointly to co-owners; co-owner (Wayne) therefore has an interest. Court: Funds treated as a grant to both owners; Road Home policy and covenants support joint ownership/interest.
Is Lisa entitled to reimbursement under co-ownership/C.C. arts. 804 & 496 for substantial improvements? Yes — she made improvements using her funds and should be reimbursed under art. 496 (cost/current value/enhanced value). No — improvements were paid with Road Home proceeds that encumbered/alienated the co-owned property; Lisa did not expend separate funds and contravened co-ownership rules. Court: Denied reimbursement; art. 804/496 do not entitle Lisa because she used jointly owned grant funds and encumbered the indivision without consent.
Does unjust enrichment/equity support Lisa's claim? Equitable relief warranted because Wayne did nothing yet benefits from repairs. No unjust enrichment — both parties benefited and there was no impoverishment; Road Home proceeds were intended for owners and created mutual economic benefit. Court: Rejects unjust enrichment claim; no inequitable transfer shown.
Did Lisa’s execution of covenants and use of proceeds improperly bind or encumber Wayne? (Implicit) Road Home contract bound the recipient (Lisa) and provided no third-party rights; Wayne not bound and therefore not entitled to funds. Road Home covenants run with the land and restrict alienation/use of the co-owned property, thereby implicating Wayne’s interests. Court: Finds Lisa’s acts created encumbrances and servitudes affecting co-owned property; thus her claim for reimbursement fails.
