Background

  • Ruth Conaway sued the Village of Mt. Orab and the Mt. Orab Police Department alleging unjust enrichment, conversion, and willful/malicious misconduct after the Mt. Orab Police Department seized a 2014 Nissan Murano co-titled to her and her husband Gregory Conaway.
  • The Murano had a lien held by JP Morgan; in Gregory Conaway's criminal case he pled guilty to OVI and a forfeiture order for the vehicle was entered and published in early 2020.
  • Appellees moved to dismiss Conaway's civil complaint under Civ.R. 12(B)(6), attaching uncertified documents from Gregory Conaway’s criminal case and arguing forfeiture procedures under R.C. 2981.04 were followed and Conaway failed to timely assert a claim in that criminal proceeding.
  • The trial court granted the 12(B)(6) dismissal, relying on the criminal-case records and reasoning that Conaway’s post-publication motion in the criminal case was untimely; the court also criticized Conaway’s counsel for having represented Gregory in the criminal case.
  • On appeal, the Twelfth District reversed: it held the trial court improperly considered matters outside the complaint (and improperly took judicial notice of another case’s proceedings) without converting the motion to summary judgment, and concluded Conaway’s complaint sufficiently pleaded unjust enrichment, conversion, and punitive-damage allegations.

Issues

Issue Plaintiff's Argument Defendant's Argument Held
Proper standard for ruling on a Civ.R. 12(B)(6) dismissal Conaway: complaint gives fair notice of claims; court must accept allegations as true Mt. Orab: dismissal proper because criminal-case records show forfeiture complied with law Court: 12(B)(6) standard applies; court may not resolve merits or consider outside materials without conversion to summary judgment
Use of criminal-case records / judicial notice on 12(B)(6) Conaway: trial court could not rely on other-case records not in her complaint Mt. Orab: court may take judicial notice and consider attachments proving notice/publication and timeliness Court: trial court abused discretion by taking judicial notice/considering other-case records on 12(B)(6) without notice and converting to summary judgment procedures
Sufficiency of pleading unjust enrichment, conversion, punitive damages Conaway: alleged co-ownership, knowledge by police, failure to follow forfeiture procedures, resulting loss and willful conduct Mt. Orab: plaintiff’s remedy was in criminal forfeiture proceeding; no viable civil claim Court: complaint sufficiently alleges unjust enrichment, conversion, and willful/malicious misconduct; dismissal improper
Effect of plaintiff's untimely collateral filing in criminal case Conaway: she wasn't properly notified and thus preserved civil claims Mt. Orab: Conaway’s failure to timely file in criminal case forecloses her claim Court: timing/res judicata factual questions cannot be resolved on 12(B)(6); factual development required
