City of Cleveland v. Olivares, 966 N.E.2d 285

Olivares, a non-resident with Salvadoran license and international permit, was cited for driving without a valid license (C.C.O. 435.01) and a minor traffic-control violation (C.C.O. 413.03) after a red-light stop.
Olivares argued she had a valid foreign license and did not need an Ohio license as a non-resident.
The municipal court granted Olivares’s motion to dismiss, ruling she was not an Ohio resident and exempt from Ohio license requirements.
The court later nolle'd the C.C.O. 435.01 charge and then indicated the C.C.O. 413.03 charge was also nolle’d, though there was a later note clarifying it was not a prosecutor’s nolle.
The City of Cleveland appealed, challenging the trial court’s conclusions and seeking reversal on multiple grounds, including interpretation of RC 4507.04 and international conventions.
The Eighth District reversed the trial court’s dismissal on due-process grounds, held the court relied on evidence outside the complaint, and remanded the case for proceedings consistent with the opinion.
