Background

  • David and Caroline Cherconis married in 1984, divorced in 2007 (no spousal support), and remarried in 2010; they separated again in 2011. The marital home was awarded to David in the first divorce but Caroline retained a $29,000 equity interest reduced by rent credits to $3,803.05.
  • In 2012 David’s sister paid off the mortgage ($38,550) and David deeded the house to her while a new divorce action was pending; Caroline continued to live in the house and was granted exclusive possession during the proceedings.
  • At the second divorce the trial court treated the sister’s $38,550 payoff as marital equity, divided it, awarded Caroline payments, and ordered David to pay $340/month spousal support until death, remarriage, or cohabitation.
  • This court previously held the $38,550 payoff was not marital equity attributable to David and ordered the trial court on remand to vacate the portion of the award based on that payment and adjust property division accordingly.
  • On remand the trial court vacated the $19,275 award but recalculated equity, ordered David to pay Caroline $23,988.08 in installments, required Caroline to vacate 90 days after first payment, and left the spousal-support award in place. David appealed further.
  • The Ninth District affirms in part, reverses in part, and remands: it sustains challenges to (1) using the first marriage to set spousal-support duration, and (2) the remand division of mortgage pay-down without adequate evidence; it overrules David’s standing-based challenge to Caroline’s occupancy because he no longer owns the house.

Issues

Issue Plaintiff's Argument (David) Defendant's Argument (Caroline) Held
Whether trial court could base spousal-support duration on combined length of first and second marriages Trial court lacked jurisdiction to modify the original (2007) no-support/order and therefore could not consider the first marriage when awarding support after remarriage Court may consider total duration when parties effectively remained marital during separation (trial court relied on precedent) Reversed in part: court erred to the extent it relied on the first marriage because the original decree expressly reserved no jurisdiction; on remand support must be considered only as to the remarriage
Whether trial court correctly awarded Caroline half of David’s net equity/pay-down share after remand Award improperly gave Caroline half of David’s separate equity/pay-down and penalized David for complying with original decree; remand calculation used unsupported figures Trial court attempted equitable division of mortgage pay-down and recalculated net equity to allocate marital share Reversed and remanded: trial court exceeded scope of remand and used figures lacking record foundation; remand required to take evidence on mortgage principal reductions and recalculate equitable division
Whether David has standing to challenge the trial court’s allowance for Caroline to stay rent-free in the home owned by his sister Challenges occupancy and 90-day vacate period as unfairly allowing rent-free occupancy in property now owned by third party Caroline had exclusive possession during proceedings; sister was joined as party but did not appeal Overruled for lack of standing: David no longer owns the home, so he lacks a personal stake to appeal the occupancy decision (sister did not appeal)
