Background

  • Bressi retained attorneys John R. Irwin and Michael Ockerman to defend multiple civil, criminal, and medical-board matters arising from allegations by over 60 women; several civil plaintiffs obtained a prejudgment attachment (Feb. 21, 2014) that froze various assets, including a $100,000 criminal bond.
  • Appellate efforts challenging the attachment and related orders were untimely and an appellate transcript of the discharge-hearing was not provided to the Ninth District; the Ninth District dismissed portions of the appeal for lack of jurisdiction and declined relief on Civ.R. 60(B) grounds.
  • Bressi sued Irwin and Ockerman for legal malpractice (plus contract and punitive claims against Irwin). The case was transferred to Geauga County; Bressi missed an expert deadline but later designated Charles J. Kettlewell as his expert.
  • Kettlewell opined appellees breached the standard of care by missing the appellate deadline and failing to file the transcript, but he did not opine that those breaches proximately caused identified losses or quantify damages.
  • Defendants submitted affidavits denying proximate causation and damages; the trial court found defendants negligent as a matter of law for missing the appeal but granted summary judgment because Bressi did not present evidentiary material showing proximate cause or damages.
  • The Eleventh District affirmed, holding that although duty/breach (missing the appeal) was established, Bressi failed to produce evidence creating a genuine issue on causation or the value of any lost claim.

Issues

Issue Plaintiff's Argument Defendant's Argument Held
Whether appellees' failure to timely appeal the prejudgment attachment and to file the transcript proximately caused Bressi's loss Bressi: missing the appeal and transcript was negligence per se and caused loss because he lacked access to attached monies Defendants: even if negligent, Bressi produced no evidence that a timely appeal or transcript would have changed the outcome or produced recoverable monies Held: Court found breach established (untimely appeal is negligence) but Bressi failed to show proximate cause; summary judgment proper.
Whether Bressi produced evidence of damages attributable to the malpractice (including attorney fees) Bressi: loss consisted of inability to access attached assets and attendant harm; expert unnecessary to prove damages tied to the attachment appeal Defendants: no evidentiary proof of damages; affidavits state no act or omission proximately caused damage Held: Court held Bressi failed to submit evidentiary-quality proof of damages or expert opinion tying breaches to quantifiable loss; summary judgment proper.
