Article 3
Services for Pregnant Women

7 AAC 55.610. Purpose. Subject to the appropriation of money and the provisions of AS 47.40.100 - 47.40.120, the department will purchase certain services for eligible women and will award grants to eligible applicants to provide services for eligible women.

7 AAC 55.620. Eligible applicants. An applicant for a grant under 7 AAC 55.610 - 7 AAC 55.690 shall provide proof to the department that it has all licenses, permits, and license designations that the state, federal, or municipal governments require for providing the services, including licenses required by 7 AAC 50.

7 AAC 55.630. Applications. (a) In a grant application, the applicant shall include (1) proof that the applicant has all licenses that are necessary to allow the applicant to provide the service it proposes to provide; (2) a service plan; and (3) a proposed budget. (b) In its service plan the applicant shall project its activities for the period of the grant and shall offer to provide eligible services to eligible women, as follows: (1) A statement of projected activities must describe (A) all services that the applicant will provide, including services under the grant and other services, and the program objectives of the applicant for each service; and (B) the number of women that the applicant will serve under the grant. (2) An offer to provide services must designate (A) the community or communities where the applicant will provide services under the grant; (B) the period for which the applicant will provide services under the grant; (C) the location at which the applicant will provide services under the grant; (D) the maximum dollar amount that the applicant proposes will be the cost of services the applicant will provide under the grant; (E) the manner in which the applicant will meet any special requirements that the department specifies in the request for proposals and grant application instructions.

7 AAC 55.640. Eligible women. (a) The department will assist only those pregnant women who meet both the economic need criteria and the social need criteria described in this section. (b) A pregnant woman meets the economic need criteria for assistance if she or her family is presently eligible for Adult Public Assistance, AFDC, Food Stamps, General Relief or Medicaid, and if her need was considered in finding her or her family eligible for assistance. A pregnant woman also meets the economic need criteria for assistance if she is currently a participant in the Special Supplemental Food Program for Women, Infants and Children. (c) A pregnant woman meets the social need criteria for assistance if she (1) is under 18 years of age; (2) is the subject of a pending petition for adjudication of child in need of aid under AS 47.10.011, or of delinquency under AS 47.12.020 and 47.12.040, or the subject of a comparable adjudication in another state; (3) has a history of physically or sexually abusing a child or children; (4) has been physically or sexually abused as a minor; (5) has a history of running away from home; (6) has a history of felony arrests or misdemeanor arrests; (7) has a history of alcohol or drug abuse; or (8) has a history of truancy. (d) A pregnant woman must apply to the subunit of the appropriate department for a determination of her eligibility for services. That subunit will assist the woman in applying and will supply forms for the application. That subunit may determine which services are available and appropriate for the woman, and whether money is available to provide those services. (e) The department will cease to assist women 30 days after the woman ceases to be pregnant. (f) A pregnant woman who is aggrieved by a decision of the subunit that she is not eligible for services may request a hearing, using the same procedures as those set out in 7 AAC 49.

7 AAC 55.650. Eligible services. (a) The department will purchase or provide the following services for pregnant women: (1) transportation to and from a maternity home or a foster home; (2) counseling; (3) adoption assistance; (4) maternity care; (5) foster care; (6) education in parenting skills; and (7) other services that are ancillary to any of the services listed in this subsection. (b) The department will designate the successful applicants from whom a pregnant woman may receive services.

7 AAC 55.660. Insufficient appropriations. (a) In its discretion, the department will not offer all of the services described in 7 AAC 55.650(a) if it finds that insufficient money was appropriated to provide all services to all eligible women during a fiscal year. (b) If the department finds that insufficient money was appropriated to serve all eligible women, the department will cease to offer services to women, based upon their classification of social need listed in 7 AAC 55.640(c). The department will first cease to offer services to women 18 years of age and older in inverse order of the social need classifications listed in 7 AAC 55.640(c). If the department finds that money is insufficient to serve the remaining applicants, the department will then cease to offer services to women under 18 years of age, using the same priority system.

7 AAC 55.670. Program standards and requirements. In the grant application information that it provides to applicants, the department will describe the kinds of services for which it will award grants, and will designate program standards for grantees. In its discretion, the department will set standards in addition to the standards necessary for licensure.

7 AAC 55.680. Website information related to pregnancy and pregnancy alternatives. (a) The department maintains an Internet website as required by AS 18.05.032 that provides information relating to pregnancy and pregnancy alternatives, including reproductive options and potential consequences to assist women in making informed reproductive choices. The website is in printable format and contains the information required by AS 18.05.032. (b) The department will review and update, as necessary, the website described in (a) of this section at least annually to ensure that the current and accurate information is available on the website. (c) The most current information prepared under this section is contained on the Internet website titled Making a decision about your pregnancy, dated July 14, 2005, and is adopted by reference.

7 AAC 55.690. Definitions for 7 AAC 55.610 - 7 AAC 55.690. As used in 7 AAC 55.610 - 7 AAC 55.690 (1) "commissioner" means (A) the commissioner of health, with respect to maternity homes, and with respect to purchases made by the Department of Health; (B) the commissioner of family and community services, with respect to foster homes, and with respect to purchases made by the Department of Family and Community Services; (2) "counseling" means nonmedical professional services designed to guide the pregnant woman and her family to a better understanding of her problems and potentialities by using modern psychological principles and methods, including the collection of case history data, the use of techniques of personal interview, and the testing of her interests and aptitudes; (3) "department" means (A) the Department of Health, with respect to maternity homes, and with respect to purchases made by the Department of Health; (B) the Department of Family and Community Services, with respect to foster homes, and with respect to purchases made by the Department of Family and Community Services; (4) repealed 7/1/2022; (5) repealed 7/1/2022; (6) "education in parenting skills" means training of women using a curriculum at least as comprehensive as Parent Effectiveness Training (PET) by Thomas Gordon, PH Wyden Books, New York - 1976; (7) "foster care" means care provided in a foster home; (8) "foster home" has the meaning given in AS 47.32.900; (9) "maternity care" means care to pregnant women, regardless of age, before or after the woman gives birth, or that provides care, as needed, to mothers and their children; (10) "maternity home" has the meaning given in AS 47.32.900.
